How foreigners in Korea can protect themselves from discrimination and illegal labor conditions

South Korea remains one of the popular destinations for labor migration. Hundreds of thousands of foreigners come here to work in industry, construction, on farms, and in the service sector. But along with opportunities to earn, many also face problems: delayed wages, discrimination, poor living conditions, and sometimes direct violations of human rights.

The Ministry of Employment and Labor of the Republic of Korea (고용노동부) emphasizes: foreign workers have the same labor rights as citizens of the country, and no one has the right to infringe upon them due to nationality or status.

What rights does the law protect?

Equality in wages — employers are obliged to pay foreign employees no less than Korean employees, including observing the minimum wage.

Right to rest and vacation — an employee cannot be deprived of legally mandated breaks and paid days off.

Protection from violence and harassment — verbal abuse, physical assault, or sexual harassment are unacceptable.

Compensation for accidents — all foreign workers have the right to insurance payments for occupational injuries.

Right to decent housing — employers are obliged to provide safe living conditions and not withhold excessive amounts for food and housing.
