The recent incident where a South Korean worker in their 50s lifted a Sri Lankan migrant worker with a forklift and mocked them cannot be dismissed as mere 'prank'; it reveals a shameful aspect of our society that cannot be overlooked. This is a symbolic event that vividly illustrates the everyday and dangerous level of human rights violations and discrimination experienced by migrant workers in the workplace. Apart from the perpetrator's apology, there are strong voices calling for a thorough investigation into the structural issues underlying the incident.
'Reporting Means Immediate Dismissal'… The Employment Permit System Becomes a Shackle, Forcing Silence
The dominant view is that the root of the problem lies in the current Employment Permit System, which strictly restricts the movement of migrant workers between workplaces. This system ties migrant workers to a specific workplace, creating a structure where they are forced into silence, unable to report due to fear of repercussions, even when subjected to unfair treatment or workplace bullying. Ultimately, workers are driven into blind spots of human rights under the absolute authority of employers, which serves as the fundamental background for discrimination and bullying.
Discrimination Proven by Numbers, a Blind Spot for 'Workplace Bullying'
Actual data objectively proves the reality faced by migrant workers. According to the National Human Rights Commission's 2023 'Survey on the Status of Migrant Human Rights Guidelines,' 4 out of 10 migrant workers (41.6%) responded that they wanted to change workplaces but could not because 'the employer did not consent.' Furthermore, while the number of workplace bullying reports filed with the Ministry of Employment and Labor is increasing annually, experts commonly analyze that the actual scale of damage suffered by migrant workers, who face language barriers and employment instability, is festering unrecorded in statistics. An official from the civic group 'Migrant Workers' Human Rights Center' testified, "A considerable number of consultation cases involve verbal abuse and unfair work assignments, but very few lead to formal problem resolution out of fear of dismissal."
Without System Improvement, 'The Second Forklift Incident' Cannot Be Prevented… Government Accountability Emerges
To prevent recurring tragedies, it is urgent to establish institutional alternatives beyond the punishment of individuals. The government and the Ministry of Employment and Labor have a responsibility to expand, even if limited, the freedom of migrant workers to change workplaces and to strengthen practical protection and remedy procedures for victims of workplace bullying. It is time to seriously consider the criticism that without fundamental reform of the Employment Permit System, which causes discrimination and exploitation, 'the second forklift incident' cannot be prevented, going beyond simply punishing perpetrators.
